International Law and Sexual Violence in Armed Conflicts

Eboe-Osuji (a judge of the International Criminal Court) seeks to address how international law can better confront the problem of sexual violence against women in armed conflicts. The analysis rests upon the review of problems identified in cases litigated before international criminal tribunals as considered against the background of theories of the causes for sexual violence in armed conflict. Chapters address the law of superior responsibility for assaults by subordinates, the definition of rape in international criminal law, the theory of rape as an act of genocide, recent terrorism jurisprudence on the question of specific intent, the principle of "grave breaches" and its application in international and internal armed conflicts, recent attempts to recognize forced marriage as a distinct crime in international law, the prosecution of sexual violence in justice and social reconstruction programs in post-conflict societies, and the question of reparation for victims of human rights violations in armed conflict.
