本書為憲法學新視野系列論文集第二冊的修訂再版，收錄的論文前四篇屬於方法論的研究，後五篇則分別為社會理論、族群研究、歷史論述等不同取向的論文，各篇論文在研究議題與研究方向上雖有分歧，然而其背後有一個共同的關懷：為台灣憲法學研究找到一個活水源頭。「法的科際整合研究」（interdisciplinary studies in law），標示著學術界對於學科分殊化的反省與質疑，以及再度找回失落整體的努力，然而interdisciplinary studies只意味著「跨」學科研究，而非學科之間發生了任何意義的「整合」。傳統法學的自主性可能是一個幻覺，或至少是一個欠缺自我反思的明證，無論在理論基礎、社會事實的確定，或是採納其他專業領域知識等方面，作為台灣法學典範的法釋義學均有賴於其他學科的奧援。為法學提供更多元的視野，是突破傳統法學困境的有用方法，在學科分工已蔚為主流的學術環境裡，跨學科研究是辛苦與不討好的，但是如果本論文集的論述已經提出正確的問題，正確的答案就在不遠之處。
