How ought the law to deal with novel challenges regarding the use and control of human biomaterials? As it stands the law is ill-equipped to deal with these. Quigley argues that advancing biotechnology means that the law must confront and move boundaries which it has constructed; in particular, those which delineate property from non-property in relation to biomaterials. Drawing together often disparate strands of property discourse, she offers a philosophical and legal re-analysis of the law in relation to property in the body and biomaterials. She advances a new defence, underpinned by self-ownership, of the position that persons ought to be seen as the prima facie holders of property rights in their separated biomaterials. Simple paradigms of Muslim-Christian confrontation and the rise of Europe in the seventeenth century do not suffice to explain the ways in which European mapping envisioned the 'Turks' in image and narrative. Rather, maps, travel accounts, compendia of knowledge, and other texts created a picture of the Ottoman Empire through a complex layering of history, ethnography, and eyewitness testimony, which juxtaposed current events to classical and biblical history; counted space in terms of peoples, routes, and fortresses; and used the land and seascapes of the map to assert ownership, declare victory, and embody imperial power's reach. In the Atlantic World, different groups were aromatically classified in opposition to other ethnic, gendered, and class assemblies due to an economic necessity that needed certain bodies to be defined as excremental, which culminated in the creation of a progressive tautology that linked Africa and waste through a conceptual hendiadys born of capitalist licentiousness. The African subject was defined as a scented object, appropriated as filthy to create levels of ownership through discourse that marked African peoples as unable to access spaces of Western modernity. Respect for autonomy has become a fundamental principle in human research ethics. Nonetheless, this principle and the associated process of obtaining informed consent do have limitations. This can lead to some groups, many of them vulnerable, being left understudied. This book considers these limitations and contributes through legal and philosophical analyses to the search for viable approaches to human research ethics. It explores the limitations of respect for autonomy and informed consent both in law and through the examination of cases where autonomy is lacking (infants), diminished (addicts), and compromised (low socio-economic status). What did the term 'author' denote for Lutheran musicians in the generations between Heinrich Schütz and Johann Sebastian Bach? As part of the Musical Performance and Reception series, this book examines attitudes to authorship as revealed in the production, performance and reception of music in seventeenth-century German lands. Analysing a wide array of archival, musical, philosophical and theological texts, this study illuminates notions of creativity in the period and the ways in which individuality was projected and detected in printed and manuscript music. Its investigation of musical ownership and regulation shows how composers appealed to princely authority to protect their publications, and how town councils sought to control the compositional efforts of their church musicians. Interpreting authorship as a dialogue between authority and individuality, this book uses an interdisciplinary approach to explore changing attitudes to the self in the era between Schütz and Bach.
