EU and US Antitrust Arbitration

What began in 2006 as a much more circumscribed project evolved over five years into a two-volume reference comprising 48 contributed chapters and occupying more than 2,000 pages. The editors didn't just sit back and open the doors. Rather, they've shaped the structure and scope of the reference without limiting the diversity of perspectives important to this multifaceted topic. They've also been selective about appendices, choosing to include summary tables rather than primary documents, which are available elsewhere. Contributions are arranged in sections on general issues, the specifics of EU and US law, antitrust arbitration in merger control, and institutional antitrust arbitration under ICC Rules. Chapters address arbitration clauses and competition law from arbitrator's and user's perspectives; burden and standard of proof in international arbitration; effective use of economic experts; and court review of competition law awards in setting aside and enforcement proceedings, among many other topics. The editors note that they have "...generally not drawn any particular distinction between the use of `competition' and `antitrust' and have by and large employed these terms synonymously" although they acknowledge some differences in use in EU and US contexts.
