Completed as a doctoral thesis at Erasmus U. in the Netherlands, this book addresses the problem of uncertainty in the law applicable to the multimodal contract of carriage (i.e. contracts concerning transportation of goods by different modes of transport), citing both uncertainty within the law as to the legal consequences of loss, damage, or delay resulting from carriage when contracting parties are entering into a multimodal transport agreement as well as different ideas about the law in different jurisdictions, including in the interpretation of international conventions. The author conducts an analysis of the current legal framework in relation to multimodal carriage and how within this framework the law applicable to a multimodal contract may be uncovered. The focus is on the ideas, legislation, and case law on multimodal carriage in the civil law systems of Germany and the Netherlands and in the English common law system.
