His most significant concern is on the question of legitimacy in the absence of the democratizing effect of the jury system. In the end he finds that under certain circumstances, most notably the possibility of terrorist intimidation of juries, the interests of justice may require the dispensing of juries and that therefore the Special Criminal Court may be "extremely distasteful," but it is also moderate, legitimate, and proportionate.
