商品簡介
Based on the author's doctoral thesis at the U. of London, this volume examines the origins and development of international humanitarian law and Islamic law of war from their beginnings to present-day conflicts in the Islamic and Middle Eastern world. It considers the principles of protection in warfare under this law, such as distinction and proportionality; the ideological foundations and contexts that have influenced it, focusing on the history of Western and Islamic concepts of self and the enemy other and how these are reflected in the interpretation and application of the principles of protection; and the structure of legal arguments, discussing jurisdictional regimes and the principles of proportionality and military necessity.
