Der Begriff der "Konstitutivit酹" beschreibt ein wechselseitiges Verh鄟tnis von Literatur und Recht, das sich in ihrer Entstehung, Pr輍ung und Aufhebung manifestieren kann. Der Band untersucht, was diese in der Forschung seit Langem postulierte reziproke Konstitutivit酹 tats踄hlich umfasst, und er鐪fnet neue Perspektiven auf die Konzeptualisierung konstitutiver Beziehungen zwischen Recht und Literatur. The concept of "constitutivity" describes a mutual relation between literature and law, which manifests itself in their reciprocal initiation, shape, and abolishment. The volume examines what the long-held assumption of the mutual constitutivity of law and literature actually entails, thereby offering new perspectives on the conceptualization of their constitutive relations. Constitutivity is contextualised alongside materiality and comparativity as part of a tripartite taxonomy describing the relations between law and literature. The volume also addresses questions of the normativity of law and genre, the interrelations of law, literature and (post)nation across diverse geographical and historical contexts, as well as the relationship between law and the publication and distribution of books.
