本書基於美國傳聞法治與對質條款之相關發展，指出在保障對質詰問權之規範目的下，傳聞法則之適用應以是否有保障對質詰問權之必要為核心議題。由於在不涉及對質詰問權保障之情形中，本無排除審判外陳述之必要，因此，現行司法實務有關傳聞例外如何適用之主張，即有檢討之空間。而在分別探討刑事訴訟法第159條之1至第159條之5之法理基礎與適用疑義後，本書乃針對相關的實務爭議問題予以澄清，期能為司法實務提供具體的參考。
