Previous efforts at legal development have focused almost exclusively on state legal systems, many of which have shown little improvement over time. Recently, organizations engaged in legal development activities have begun to pay greater attention to the implications of local, informal, indigenous, religious and village courts or tribunals, which often are more efficacious than state legal institutions, especially in rural communities. Legal pluralism is the term applied to these situations because these institutions exist alongside official state legal systems, usually in a complex or uncertain relationship. Although academics, especially legal anthropologists and sociologists, have discussed legal pluralism for decades, their work has not been consulted in the development context. Historians often refer to past events which took place prior to their narrative's proper past - that is, they refer to a 'plupast'. This past embedded in the past can be evoked by characters as well as by the historian in his own voice. It can bring into play other texts, but can also draw on lieux de mémoire or on material objects. The articles assembled in this volume explore the manifold forms of the plupast in Greek and Roman historians from Herodotus to Appian. The Norwegian explorer and ethnographer Carl Lumholtz (1851–1922) wrote the influential ethnographic studies Among Cannibals and Unknown Mexico (both reissued in this series) after his journeys through Australia and Mexico respectively. In 1913, Lumholtz went on his final expedition, which aimed to explore the large parts of Borneo unknown to the rest of the world. Interested by tales of head-hunting, he wanted to spend time with the indigenous people and conduct research. Originally published in 1920, this two-volume work is Lumholtz's account of his expedition. Many of the illustrations in the work are from photographs taken by the author, including pictures of members of the different tribes he stayed with. Volume 1 begins with an overview of Borneo and goes on to describe the expedition's journey into the jungle, and the various ceremonies experienced during the journey, which provide interesting insights into tribal life and belief systems.

How do Family and Medical Leave Act rights operate in practice in the courts and in the workplace? This empirical study examines how institutions and social practices transform the meaning of these rights to recreate inequality. Workplace rules and norms built around the family wage ideal, the assumption that disability and work are mutually exclusive, and management's historical control over time all constrain opportunities for social change. Yet workers can also mobilize rights as a cultural discourse to change the social meaning of family and medical leave. Drawing on theoretical frameworks from social constructivism and new institutionalism, this study explains how institutions transform rights to recreate systems of power and inequality but at the same time also provide opportunities for law to change social structure. It provides a fresh look at the perennial debate about law and social change by examining how institutions shape the process of rights mobilization.

Since Aristotle, many different theories of distributive justice have been proposed, by philosophers as well as social scientists. The typical approach within social choice theory is to assess these theories in an axiomatic way – most of the time the reader is confronted with abstract reasoning and logical deductions. This book shows that empirical insights are necessary if one wants to apply any theory of justice in the real world. It does so by confronting the main theories of distributive justice with data from (mostly) questionnaire experiments. This work by Sir James Frazer (1854–1941) is widely considered to be one of the most important early texts in the fields of psychology and anthropology.
