Realizing Autonomy

This tribute to Professor Detlev Vagts of the Harvard Law School brings together his colleagues at Harvard and the American Society of International Law, as well as academics, judges and practitioners, many of them his former students. Their essays span the entire spectrum of modern transnational law: international law in general; transnational economic law; and transnational lawyering and dispute resolution. The contributors evaluate established fields of transnational law, such as the protection of property and investment, and explore new areas of law which are in the process of detaching themselves from the nation-state such as global administrative law and the regulation of cross-border lawyering. The implications of decentralised norm-making, the proliferation of dispute settlement mechanisms and the rising backlash against global legal interdependence in the form of demands for preserving state legal autonomy are also examined.

Alice Thornton (1626–1707) was a middle-class woman who was best known for her autobiography describing the English Civil War and its effects on her life. She was the daughter of Christopher Wandesford (1592–1640), Lord Deputy of Ireland, and enjoyed a privileged upbringing. His death, followed by the Civil War, caused a crisis in the family, who eventually settled in Yorkshire in considerably straitened circumstances. This volume, first published in 1873 by the Surtees Society, contains the first published edition of Thornton's autobiography, which provides fascinating details of her life. Her relationships with her husband and children are fully described, and she writes candidly concerning her health problems, pregnancies, and the deaths of six of her nine children. This tribute to Professor Arthur von Mehren from the Harvard Law School is a contribution to the evolving transatlantic dialogue on the conflict of laws. It contains ten contributions that discuss the problems conflict of laws is facing in a globalized world. The Groundwork of the Metaphysics of Morals is Kant's central contribution to moral philosophy, and has inspired controversy ever since it was first published in 1785. Caroline Norton (1808–1877) was a Victorian author and campaigner for social reform, especially reform of women's legal rights. In this lucidly written account Norton describes how upon marriage in 1855 women became legally 'non-existent': they could not bring cases to court; they could not enter into a contract; they could not instigate a divorce and their possessions, earnings and any bequests made to them automatically became their husband's property. Norton explains how this lack of legal autonomy affected women if they became estranged from their husbands, using her own experiences for illustration and recommending changes which would improve women's legal position. Published in 1855 when Parliament was debating the subject of divorce reform, this volume shows the legal position of women at this time. It provides the opinions of contemporary legislators in support and opposition on the issues of women's legal rights and reform of divorce laws.

What impact does a falling birth rate have on the strength and vitality of a nation? Are citizens duty-bound to think about this question when they make reproductive and sexual choices? Few countries have grappled with these questions so intensely and with such dramatic consequences as Germany. Annette Timm tracks how fears of a declining population influenced reproductive and sexual health policy in Germany from the end of World War I through the period of German division in the Cold War. A case study set in Berlin, the book examines local measures to control venereal diseases and influence reproductive choices in marriage counseling clinics. It investigates how policies meant to encourage higher birth rates created feelings of belonging even as they infringed upon personal autonomy. The idea that sexual duty should be central to conceptions of citizenship only died with the changing circumstances of the late Cold War.

First published in 1985, this multi-author volume discusses the contentious issue of the relationship between shop floor bargaining and the state. Previous studies of this area tended to focus on macro-economic concerns and labour legislation, avoiding a more empirical approach that would draw out specific examples of the relationship. The seven essays in this text attempt to redress the balance through rigorous analysis of historically particular circumstances and events. In doing so, they show that the state is not always the defender of managerial centralisation and give examples of government intervention to the benefit of shop floor autonomy. The long revolutionary movements that gave birth to constitutional democracies in the Americas were founded on egalitarian constitutional ideals. They claimed that all men were created equal with similar capacities and also that the community should become self-governing. Following the first constitutional debates that took place in the region, these promising egalitarian claims, which gave legitimacy to the revolutions, soon fell out of favor. Advocates of a conservative order challenged both ideals and favored constitutions that established religion and created an exclusionary political structure. Liberals proposed constitutions that protected individual autonomy and rights but established severe restrictions on the principle of majority rule. Radicals favored an openly majoritarian constitutional organization that, according to many, directly threatened the protection of individual rights. Changes in the field of central banking over the past two decades have been nothing short of dramatic. They include the importance of central bank autonomy, the desirability of low and stable inflation, and the vital role played by how central banks communicate their views and intentions to the markets and the public more generally. There remains considerable diversity nevertheless in the institutional framework affecting central banks, the manner in which the stance of monetary policy is determined and assessed, and the forces that dictate the conduct of monetary policy more generally. The global financial crisis, which began in the United States in 2007, only serves to highlight further the importance of central bank policies. The aim of this volume is to take stock of where we are in the realm of the practice of central banking and considers some of the implications arising from the ongoing crisis.

Challenging received views of music in nineteenth-century German thought, culture and society, this 2010 book provides a radical reappraisal of its socio-political meanings and functions. Garratt argues that far from governing the nineteenth-century musical discourse and practice, the concept of artistic autonomy and the aesthetic categories bequeathed by Weimar classicism were persistently challenged by alternative models of music's social role. The book investigates these competing models and the social projects that gave rise to them. It interrogates nineteenth-century musical discourse, discussing a wide range of manifestos championing musical democratization or seeking to make music an engine for the transformation of society. In addition, it explores institutions and movements that attempted to realize these goals, and compositions - by Mendelssohn, Lortzing and Liszt as well as Wagner - in which the relation between aesthetic and social claims is programmatic.

The combined forces of mission evangelism and colonial intervention have transformed the everyday family life of Pacific peoples. The dramatic changes that affected the political and economic autonomy of indigenous people in the region also had significant effects on domestic life. The district of Epiros in north-western Greece became an independent province following the Fourth Crusade and the dismemberment of the Byzantine Empire by the Latins in 1204. It retained its independence despite the recovery of Constantinople by the Greeks in 1261. Each of its rulers acquired the Byzantine titles of Despot, from which the term Despotate was coined to describe their territory. They preserved their autonomy partly by seeking support from their foreign neighbours in Italy. The fortunes of Epiros were thus affected by the expansionist plans of the Angevin kings of Naples and the commercial interests of Venice. Until 1318 it was governed by direct descendants of its Byzantine founder. Thereafter it was taken over first by the Italian family of Orsini, then conquered by the Serbians, infiltrated by the Albanians, and appropriated by an Italian adventurer, Carlo Tocco. In Modernist Writing and Reactionary Politics, Charles Ferrall argues that the politics of Yeats, Pound, Eliot, Lawrence, and Wyndham Lewis were a response to the separation of art from an increasingly industrialised society. Fascism became attractive to these writers because it promised to reintegrate art into society while simultaneously guaranteeing its autonomy. Yet with the exception of Pound and Yeats, these writers all finally rejected fascism, preferring instead to see the aesthetic as a sphere in permanent opposition to liberal democracy, rather than the basis for a new social order. Individual chapters focus on Yeats and decolonisation, Pound and 'the Jews', Eliot and the uncanny, and Lawrence and homosexuality, and Lewis and the Cartesian primitive. First published in 1934, this historical survey of the application of the Poor Law in Cambridgeshire covers the period from its codification under Queen Elizabeth I to the Amendment Act of 1834. Resulting from the author's extensive analysis of parish records, accounts and court proceedings, the examination of a largely agricultural county marks it out from many other such studies. Cambridgeshire is a unique area; although under a strong metropolitan influence due to its geographical proximity to London and its links to the capital via the University of Cambridge, it contains few towns or large villages. The scattered population meant efforts to group areas for the purposes of administration during the period in question were largely unsuccessful. Instead, E.M. Hampson's study reveals that local autonomy led to large variations in the application of the Poor Law.

Naturalistic Hermeneutics, first published in 2005, proposes the position of the unity of the scientific method and defends it against the claim to autonomy of the human sciences. Mantzavinos shows how materials that are 'meaningful', more specifically human actions and texts, can be adequately dealt with by the hypothetico-deductive method, the standard method used in the natural sciences. The hermeneutic method is not an alternative method aimed at the understanding and the interpretation of human actions and texts, but it is the same as the hypothetico-deductive method applied to meaningful materials. The central thesis advocated by Mantzavinos is, thus, that there is no fundamental methodological difference between natural sciences, social sciences, and humanities. Advanced students and professionals across philosophy, social and political theory, and the humanities will find this a compelling and controversial book.

This is a study of the central questions of explanation in the social sciences, and a defence of 'holism' against 'individualism'. In the first half of the book Susan James sets out very clearly the philosophical background to this controversy. She locates its source not at the analytical level at which most of the debate is usually conducted but at a more fundamental, moral level, in different conceptions of the human individual. In the second half of the book she examines critically three case studies of holistic approaches - Althusser, Poulantzas and the Annales historians - and progressively refines our sense of the strengths and deficiencies of their programmes. She ends by arguing for a form of concessive holism, which offers some accommodation to liberal conceptions of individual autonomy but continues to emphasise the explanatory importance of social regularities and environments.

Thisstudy of urban society in twelfth-century mainland Norman Italy examines the self-governing role of urban communities and explores their social ordering, identities and communal activities. Drawing on charters, chronicles, annals and other sources, Paul Oldfield uncovers notable continuities in a range of cities across southern Italy throughout a period of regime change and disruption. Unlike traditional interpretations which suggest that the Normans, and the creation of a monarchy in 1130, stifled urban development, this book suggests that south Italian urban communities were still able to enjoy a level of autonomy under the Norman monarchy. By emphasising the fluidity of the social structures and groups found in these cities, alongside the influential role of both the Church and civic consciousness, the author sheds light on the multi-layered complexity of the urban communities of Norman Italy and provides a more balanced comparison with the cities of northern Italy.

Novel Arguments argues that innovative fiction - by which is meant writing that has been variously labelled as postmodern, metafictional, experimental - extends our ways of thinking about the world, rejecting the critical consensus that, under the rubrics of postmodernism and metafiction, homogenises this fiction as autonomous and self-absorbed. The Tehran Bazaar has always been central to the Iranian economy and indeed, to the Iranian urban experience. Arang Keshavarzian's fascinating book compares the economics and politics of the marketplace under the Pahlavis, who sought to undermine it in the drive for modernisation and under the subsequent revolutionary regime, which came to power with a mandate to preserve the bazaar as an 'Islamic' institution. The outcomes of their respective policies were completely at odds with their intentions. Despite the Shah's hostile approach, the bazaar flourished under his rule and maintained its organisational autonomy to such an extent that it played an integral role in the Islamic revolution. Conversely, the Islamic Republic implemented policies that unwittingly transformed the ways in which the bazaar operated, thus undermining its capacity for political mobilisation. Arang Keshavarizian's book affords unusual insights into the politics, economics and society of Iran across four decades.

Syncretism - where a single form serves two or more morphosyntactic functions - is a persistent problem at the syntax-morphology interface. It results from a 'mismatch' whereby the syntax of a language makes a particular distinction but the morphology does not. This pioneering book provides a full-length study of inflectional syncretism, presenting a typology of its occurrence across a wide range of languages. The implications of syncretism for the syntax-morphology interface have long been recognised: it argues either for an enriched model of feature structure (thereby preserving a direct link between function and form), or for the independence of morphological structure from syntactic structure. Students of politics have pondered this question, and social scientists have scrutinized formal political institutions and the distribution of power among agencies of the government and the state. But we still lack a rich bank of data measuring the power of specific governmental agencies, particularly national legislatures. Based on vivid court records and newspaper advertisements, this 2003 book is a pioneering account of the expectations and experiences of married life among the middle and labouring ranks in the long eighteenth century. Its original methodology draws attention to the material life of marriage, which has long been dominated by theories of emotional shifts or fashionable accounts of spouses' gendered, oppositional lives. Thus it challenges preconceptions about authority in the household, by showing the extent to which husbands depended upon their wives' vital economic activities: household management and child care. Not only did this forge co-dependency between spouses, it undermined men's autonomy. The power balance within marriage is further revised by evidence that the sexual double standard was not rigidly applied in everyday life. Should an international competition agreement be incorporated into the World Trade Organization? Taylor examines this question, arguing that such an agreement would be beneficial. Existing initiatives towards the regulation of cross-border, anti-competitive conduct have clear limitations that could be overcome by an agreement, and the WTO would provide the optimal institutional vehicle for it. At a practical level, Taylor points out, an international competition agreement could address under-regulation and over-regulation in the trade-competition regulatory matrix, realizing substantive benefits to international trade and competition. This book identifies the appropriate content and structure for a plurilateral competition agreement and proposes a draft negotiating text with accompanying commentary, and as such will be an invaluable tool for policy-makers, WTO negotiators, competition and trade lawyers, and international jurists.

This is a scholarly book by a leading Ghanaian historian and Methodist. It gives a full and co-ordinated story of the growth of the Methodist Church in Ghana which achieved autonomy in 1961 after 126 years of tutelage under the British Methodist Conference. The last Synod of the Ghana District of the Methodist Church was held at Winneba in 1961 and requested Mr Bartels to produce an authoritative record of its history. This book is the result of his researches. The main sources have been dispatches in the Public Records Office, the London archives of the Methodist Missionary Society, the records of the Methodist Church in Ghana and the oral history of the Ghanaian people. From this material, so largely consisting of the writings of one European to another, Bartels has wrested the story of what was essentially an African institution and one which played a leading role in the political, social and economic life of the Gold Coast and in the formation of modern Ghana.

Writing and Empire in Tacitus examines how Tacitus' historiographical career serves as an argument about his personal autonomy and social value under the peculiar political conditions of the early Roman Empire. Following the arc of his career from Agricola through Histories to Annals, this book focuses on ways in which Tacitus' writing makes implicit claims about his relationship to Roman society and about the political consequentiality of historical writing.
