A reprint of two articles published in the Yale Law Journal in 1913 and 1917, and reprinted in various forms and by various publishers up to 1978. Here the introduction by Walter Wheeler Cook and the forward by Arthur L. Corbin have been replaced with a new introduction by Nigel E. Simmons (Cambridge U.). The original journal format, preserved in all previous editions, has been altered to improve the clarity of Hohfeld's paragraphing; the numbering of footnotes has been rationalized; and additional information added to improve the accuracy of some citations.
