Lam (international law, City U. of New York) notes that despite significant advances in international human rights law during recent decades, it is still unclear whether indigenous peoples can secure the right to self-determination under international law. She focuses on issues raised by the United National Working Group on Indigenous Peoples to identify obstacles that lie in the way for indigenous peoples in all parts of the world. Using both legal and social theory, she argues that the right of self-determination can and should be available to indigenous peoples, and proposes measures that the United Nations might institute to oversee the realization of that right.
