商品簡介
This casebook introduces international copyright law, focusing on the conventions administered by the World Intellectual Property Organization (WIPO), including the Berne Convention, the Rome Convention, the WIPO Performances and Phonograms Treaty, the Beijing Treaty on Audiovisual Performances, WIPO Copyright Treaty, and the Marrakesh Treaty, as well as the TRIPS Accord. The casebook is organized by issue rather than treaty and emphasizes how US and European Union law have understood and implemented their international obligations in copyright and neighboring rights. It covers the history of the WIPO and World Trade Organization and the legal institutions of the US and EU, general principles of treaty interpretation, the interaction between national and international norms, the process of international texts implemented by national courts in the US and EU in the absence of a supranational harmonizing authority, and the application of international copyright law and neighboring rights conventions to specific issues, with discussion of the international norm and its supranational interpretation, its legislative and judicial implementation in the US and EU, whether each treaty is applicable, implementation of substantive minimum standards of rights and limitations, their application, and gaps. The final section addresses conflict of laws and the application of international private law to copyright and neighboring rights. Annotation c2015 Ringgold, Inc., Portland, OR (protoview.com)
