◎濃縮關鍵考點,念會考的內容才有用 ◎極致速成,考前衝刺最有效 ◎課文解說簡潔易懂,不用死記也能拿高分 洗錢防制法算是新興的考試科目,近年開始在銀行業、郵政招考及金融基測(FIT)眾多考科中增加不少存在感,原因其實可以追溯到2016年的兆豐金事件。 當時兆豐金因違反洗錢防制法,遭紐約州金融服務署(DFS, New York Department of financial service)處以臺灣金融史上最高罰款1.8億美元,並且10日內引入DFS指定的法律遵循顧問,在付出折合新臺幣57 億的罰款與高額的顧問費後,兆豐金當年獲利縮水兩成以上。 當時DFS認為,兆豐紐約分行有六大問題:內控不佳、有疑似洗錢的可疑匯款紀錄未依洗錢防制申報、對客戶的實地查核執行不切實、風控政策不明、稽核季報未依規定送回總行、漠視金檢報告結果等。如此多具體的缺失被具體的指出,有鑑於此教訓,國內便開始加緊洗錢防制法規的修正腳步,此後幾年洗錢防制相關法規一直都是金融法界討論的熱門議題。 經過眾多學者和實務界專家共同努力,在2019年APG對臺灣的評鑑結果是最佳的「一般追蹤」(regular follow-up),讓臺灣的金融體系重新獲得國內外金融界及消費圈的肯定和信心,故持續的強化各級人員防制洗錢及打擊資恐的觀念和能力,在未來仍然是絕對有必要的。 筆者針對近年銀行招考和防制洗錢與打擊資恐專業測驗的題目進行分析,結果發現還是以法條規範的命題為主,約莫佔了76.3%;也就是說,只要「熟讀法條」至少便能掌握七成以上的分數!而剩下不到三成的考題則分布於FATF 40項建議、台灣金融研訓院出版的3本書籍和綜合應用概念,則透過本書整理的重點概念和題目解析,相信可以有效幫助考生掌握答題的思路和方向。 而本科的準備方式,建議是在理解各洗錢防制主體的基礎架構後,投注一定的心力刷題,最後務必留時間在瀏覽法條及標示重點上,如此才能確實找到記憶薄弱之處。尤其是有志郵政考試的考生,畢竟109年6月1日才調整考科,又本科過去並無歷屆考題可參考,這時以臺灣金融研訓院數年來已辦理多場考試的考古題做準備,是相當合適的。
