近年來，域外視頻取證日益成為國際民商事司法協助的熱點問題。海牙國際私法會議對域外視頻取證問題高度重視，於2019年正式發佈了《〈海牙取證公約〉下使用視頻鏈接的良好實踐指南》(Guide to Good Practice on the Use of Video-Link under the Evidence Convention，以下簡稱《視頻取證指南》)，為公約框架下視頻取證合作與衝突解決提供了重要意見和建議，引發了國際社會的廣泛關注。本書在闡述國際民事訴訟中域外視頻取證的基本問題的前提下，以《海牙取證公約》、2020年歐盟《關於成員國法院之間民商事案件取證合作的第1783號理事會規則》 (以下簡稱《歐盟取證條例》)為主要視角論述了域外視頻取證的法律程序與規則，並以中美域外取證實踐為例，重點討論了域外視頻取證領域的法律衝突及相關的衝突解決方案，同時也分析了域外視頻取證中證據出境的限制以及權利保護要求。最後針對我國在域外視頻取證領域理論與實踐的現狀與不足，提出立法建議與意見。全文除緒論和結論外，共分五章。 第一章闡述域外視頻取證制度的基本問題；第二章是域外視頻取證的法律程序；第三章是域外視頻取證的衝突及其解決；第四章是域外視頻取證的限制和權利保護問題；第五章提出在百年未有之大變局的時代背景下，構建我國域外視頻取證法律制度。伴隨信息化的潮流，域外視頻取證給國際法治合作帶來機遇，也給國際法層面的制度構建與理論探索帶來挑戰。一個具有中國特色的建立於互相尊重主權原則基礎上的更具開放性和包容性的域外視頻取證法律制度，不僅是對海牙國際私法會議《視頻取證指南》的中國回應，也有助於我國在統籌推進國內法治和涉外法治的大背景下提升涉外法治建設水平，助力我國進一步參與和引領國際法治秩序的發展與變革。
