Contemporary Issues in International Arbitration and Mediation—The Fordham Papers 2011

A keynote paper on American exceptionalism in international arbitration is followed by 25 papers from the 2011 Seventh Annual Fordham Law School Conference on International Arbitration and Mediation. Broad themes include investor-state arbitration, complex international commercial arbitration, new rules in international arbitration, arbitration in the BRIC countries, and mediation. More specifically, coverage includes expropriation by courts, revisiting the need for uniformity in the application of res judicata to international commercial and treaty-based arbitration, notable characteristics of arbitration in China, and the neurophysiology of ADR and process design, among other topics. Arthur W. Rovine has been serving as an arbitrator in international cases under ICSID, NAFTA and AAA/ICDR since he retired from Baker & McKenzie in 2005. He is also the director of the International Arbitration Conference at Fordham Law School and an adjunct professor of law at Fordham Law School.
