Mental Disability And the European Convention on Human Rights

Barlett (mental health law, U. of Nottingham School of Law), Lewis (executive director, Mental Disability Advocacy Center, Budapest) and Thorold (formerly, National Association of Mental Health, London) provide an overview of the current status of European law related to mental disability--a recent subject of concern for the European Convention on Human Rights--and speculate on future developments. The initial chapters address aspects of Convention rights, such as issues of detention in institutions, conditions within institutions, and guardianship. Subsequent chapters discuss the practicalities of litigation. The appendices contain international legal materials pertaining to mental disability rights under the Convention and recommendations and principles from the Council of Europe.
