Examining the legal issue of equality and freedom of religion in terms of women's access to leading spiritual offices, the author demonstrates that an objective evaluation of the arguments and counterarguments underpins women's equality of access to leading spiritual offices and focuses on the question of priesthood for women in the Roman Catholic Church and the exclusion of women due to a provision of the Code of Canon Law. She looks at three fictitious case studies from Roman Catholic Church practice (seminary access for a female theology student, equal payment for priests and female community administrators, and the voiding of the election of a female theologian ordained “contra legem”) to compare and evaluate the opposing positions on gender equality and religious freedom, concluding that the principle of gender equality should be valued more than the appeal to a longstanding tradition of male spiritual leadership widespread in Catholicism, Islam, and Judaism.
