Alternative Dispute Resolution (ADR) is gaining momentum in Europe, and the EU has created a cross-border European framework, the EU Directive on Certain Aspects of Mediation in Civil and Commercial Matters. Filler, affiliated with the Austrian government, conducted his research by interviewing 25 renowned European mediators and 20 business people who have used mediation extensively. This study analyzes typical areas of commercial mediation and types of disputes where it's most effective, length and costs of the process, causes of reluctance to mediate, and various approaches to mediation style, among other topics.
