This book is an introduction for the non-specialist legal practitioner and non-legal professionals. It aims to guide the reader round some of the main landmarks of the law of protected agricultural tenancies in England and Wales. Its approach is practical and not academic. Along the way it points out some of the biggest pitfalls to avoid. Hopefully, it will give the reader enough knowledge to be able to identify an agricultural law problem when they see one, and, having done so, to know that the problem may have to be dealt with using special tools, rather than by mixing and matching knowledge from other forms of commercial land-holding.
As well as updating the text of the second (2022) edition to take account of legislative changes, the third edition includes some entirely new material on the changes to the commercial occupation and suitability tests made by the Agriculture Act 2020, as well as discussion of some recent cases.
ABOUT THE AUTHOR
Dr Christopher McNall is a barrister, mediator and arbitrator. He specialises in disputes about farms and farming (and especially disputes about tenancies under the Agricultural Holdings Act 1986), taxation (especially of agricultural land, buildings and other assets), proprietary estoppel, and Inheritance Act claims. He has advised and appeared in many leading agricultural and tax cases in courts, tribunals and arbitrations throughout the UK. He holds a variety of fee-paid judicial offices, including Chairperson (Principal Judge) of the Agricultural Land Tribunal for Wales / Tribiwnlys Tir Amaethyddol Cymru. He is also a member of the Agricultural Law Association's Dispute Resolution Service and a Fellow of the Agricultural Law Association. The views expressed in this book are entirely his personal views.
