Liberty Before Liberalism
This extended essay by one of the world's leading historians seeks, in its first part, to excavate and to vindicate, the neo-Roman theory of free citizens and free states as it developed in early modern Britain. This analysis leads on to a powerful defence of the nature, purposes and goals of intellectual history and the history of ideas. As Quentin Skinner says, 'the intellectual historian can help us to appreciate how far the values embodied in our present way of life, and our present ways of thinking about those values, reflect a series of choices made at different times between different possible worlds'. This essay provides one of the most substantial statements yet made about the importance, relevance and potential excitement of this form of historical enquiry. Liberty before Liberalism is based on Quentin Skinner's Inaugural Lecture as Regius Professor of Modern History in the University of Cambridge, delivered in 1997.

British philosopher and economist John Stuart Mill (1806–73) is the author of several essays, including Utilitarianism (1863) - a defence of Jeremy Bentham's principle applied to the field of ethics - and The Subjection of Women (1869), which advocates legal equality between the sexes. This work, arguably his most famous contribution to political philosophy and theory, was first published in 1859, and remains a major influence upon contemporary liberal political thought. In it, Mill argues for a limitation of the power of government and society (democracy's 'tyranny of the majority') over the individual, and defines liberty as an absolute individual right. According to the still much debated 'harm principle', power against the individual can only be exercised to prevent harm to others. Full of contemporary relevance, this essay also defends freedom of speech as a necessary condition of social and intellectual progress.

Just War and Ordered Liberty
When is war just? What does justice require? If we lack a commonly-accepted understanding of justice – and thus of just war – what answers can we find in the intellectual history of just war? Miller argues that just war thinking should be understood as unfolding in three traditions: the Augustinian, the Westphalian, and the Liberal, each resting on distinct understandings of natural law, justice, and sovereignty. The central ideas of the Augustinian tradition (sovereignty as responsibility for the common good) can and should be recovered and worked into the Liberal tradition, for which human rights serves the same function. In this reconstructed Augustinian Liberal vision, the violent disruption of ordered liberty is the injury in response to which force may be used and war may be justly waged. Justice requires the vindication and restoration of ordered liberty in, through, and after warfare.

Religious Liberty ― Essays on First Amendment Law
The principal aim of the establishment and free exercise clauses of the First Amendment was to preclude congressional imposition of a national church. A balance was sought between states' rights and the rights of individuals to exercise their religious conscience. While the founding fathers were debating such issues, the potential for serious conflict was confined chiefly to variations among the dominant Christian sects. Today, issues of marriage, child bearing, cultural diversity, and corporate personhood, among others, suffuse constitutional jurisprudence, raising difficult questions regarding the nature of beliefs that qualify as 'religious', and the reach of law into the realm in which those beliefs are held. The essays collected in this volume explore in a selective and instructive way the intellectual and philosophical roots of religious liberty and contemporary confrontations between this liberty and the authority of secular law.

The Politics of Liberty in England and Revolutionary America

This study locates the philosophical origins of the Anglo-American political and constitutional tradition in the philosophical, theological, and political controversies in seventeenth-century England. By examining the quarrel it identifies the source of modern liberal, republican and conservative ideas about natural rights and government in the seminal works of the Exclusion Whigs Locke, Sidney, and Tyrrell and their philosophical forebears Hobbes, Grotius, Spinoza, and Pufendorf. This study illuminates how these first Whigs and their diverse eighteenth-century intellectual heirs such as Bolingbroke, Montesquieu, Hume, Blackstone, Otis, Jefferson, Burke, and Paine contributed to the formation of Anglo-American political and constitutional theory in the crucial period from the Glorious Revolution through to the American Revolution and the creation of a distinctly American understanding of rights and government in the first state constitutions.

Humanism and America:An Intellectual History of English Colonisation, 1500–1625
Humanism and America provides a major study of the impact of the Renaissance and Renaissance humanism upon the English colonization of America. The analysis is conducted through an interdisciplinary examination of a broad spectrum of writings on colonization, ranging from the works of Thomas More to those of the Virginia Company. Andrew Fitzmaurice shows that English expansion was profoundly neo-classical in inspiration, and he excavates the distinctively humanist tradition that informed some central issues of colonization: the motivations of wealth and profit, honour and glory; the nature of and possibilities for liberty; and the problems of just title, including the dispossession of native Americans. Dr Fitzmaurice presents a colonial tradition which, counter to received wisdom, is often hostile to profit, nervous of dispossession and desirous of liberty. Only in the final chapters does he chart the rise of an aggressive, acquisitive and possessive colonial ideology.

Economy, Polity, and Society:British Intellectual History 1750–1950
Economy, Polity, and Society and its companion volume History, Religion, and Culture bring together major new essays on British intellectual history by many of the leading scholars of the period, continuing a mode of enquiry for which Donald Winch and John Burrow have been widely celebrated. This volume addresses aspects of the eighteenth-century attempt, particularly in the work of Adam Smith, to come to grips with the nature of 'commercial society' and its distinctive notions of the self, of political liberty, and of economic progress. It then explores the adaptations of and responses to the Enlightenment legacy in the work of such early nineteenth-century figures as Jeremy Bentham, Tom Paine and Maria Edgeworth. Finally, in discussions which range up to the middle of the twentieth century, the volume examines particularly telling examples of the conflict between economic thinking and moral values.

On Liberty ─ With the Subjection of Women and Chapters on Socialism
On Liberty has become celebrated as the most powerful defence of the freedom of the individual, and is now widely regarded as the most important theoretical foundation for Liberalism as a political creed. The Subjection of Women is a powerful indictment of the political, social, and economic position of women. This edition, first published in 1989, brings together these two classic texts, plus Mill's posthumous Chapters on Socialism, his somewhat neglected examination of the strengths and weaknesses of various forms of socialism. The editor's substantial introduction places these three works in the context both of Mill's life and of nineteenth-century intellectual and political history. There is also a chronology of Mill's life, a bibliographical guide, and a biographical appendix of names cited in the texts.

The Language of Liberty 1660–1832:Political Discourse and Social Dynamics in the Anglo-American World, 1660–1832
This book creates a new framework for the political and intellectual relations between the British Isles and America in a momentous period which witnessed the formation of modern states on both sides of the Atlantic and the extinction of an Anglican, aristocratic and monarchical order. Jonathan Clark integrates evidence from law and religion to reveal how the dynamics of early modern societies were essentially denominational. In a study of British and American discourse, he shows how rival conceptions of liberty were expressed in the conflicts created by Protestant dissent's hostility to an Anglican hegemony. The book argues that this model provides a key to collective acts of resistance to the established order throughout the period. The book's final section focuses on the defining episode for British and American history, and shows the way in which the American Revolution can be understood as a war of religion.

Whatmore rescues the Enlightenment from today's circular debates and places it where it belongs: in the pulsing, chaotic era of its genesis and demise' Christopher de BellaigueThe Enlightenment is popularly seen as the Age of Reason, a key moment in human history when ideals such as freedom, progress, natural rights and constitutional government prevailed. In this radical re-evaluation, historian Richard Whatmore shows why, for many at its centre, the Enlightenment was a profound failure.By the early eighteenth century, hope was widespread that Enlightenment could be coupled with toleration, the progress of commerce and the end of the fanatic wars of religion that were destroying Europe. At its heart was the battle to establish and maintain liberty in free states – and the hope that absolute

The Prophet of Modern Constitutional Liberalism:John Stuart Mill and the Supreme Court
John Stuart Mill is the father of modern liberalism. His most remembered work, On Liberty, which was published in 1859, changed the course of the liberal tradition. What is less well-known is that his ideas have profoundly influenced the American constitutional rights tradition of the latter half of the twentieth century. Mill's 'harm principle' inspired the constitutional right to privacy recognized in Griswold v Connecticut, Roe vs Wade and other cases. His defense of freedom of expression influenced Justices Holmes, Brandeis, Douglas, Brennan and others and led to greatly expanded freedom of speech in the twentieth century. Finally, Mill was an ardent feminist whose last important work, The Subjection of Women, was a full-scale and, for its time, radical defense of complete gender equality. This is a book for lawyers who want to understand the intellectual origins of modern constitutional rights, and for political philosophers interested in the constitutional implications of Mill's

Exploring republican ideas and concepts that developed in sixteenth-century Poland under the impact of humanism and the Renaissance, as well as political and constitutional changes, this is a landmark study of republican discourse in sixteenth-century Poland-Lithuania. It provides a conceptual and contextual analysis of the rich political literature and debate which animated intellectual life and political reasoning during the Polish-Lithuanian Commonwealth, and effectively demonstrates its republican character. Using a comparative perspective, Dorota Pietrzyk-Reeves situates the Polish republican discourse within both the classical and early modern republican traditions, bringing together contexts and ideas that have traditionally been overlooked by scholars of early modern Europe. In addition, she also underlines the originality of Polish concepts such as the relationship between law, liberty and virtue as key elements of a well-ordered commonwealth and the vision of a mixed res publ
