全球變暖等氣候問題事關全人類的生命健康和經濟社會的發展，單一國家和區域的應對措施已經無法有效化解其造成的損害和威脅，需要各國通力合作才能夠實現減排的共同目標。在應對氣候變化的諸多合作路徑中，碳交易的協調合作，作為兼顧實現氣候治理目標和經濟效益的有效途徑，被各國廣泛應用。《京都議定書》下的“京都三機制”對國際碳交易進行了里程碑式的發展，但因制度規則的不合理被《巴黎協定》下的相關機制所更替。《巴黎協定》在繼承發展《京都議定書》中碳交易有關規則的基礎之上，構建了兩種碳交易機制的框架，即第6條第2款下的以國際轉讓減緩成果(Internationally Transferred Mitigation Outcomes，ITMOs)為標的的交易機制，以及第6條第4款下的可持續發展機制(Sustainable Development Mechanism，SDM)。前者鼓勵各國達成碳市場鏈接等合作協議；後者則著力建立國際統一碳市場。但需要注意的是，上述兩種框架的具體實施仍處於談判協商階段，且各締約方的爭議點較多，一時無法達成共識。再加上，當前主要發達國家國內碳市場發展較完善，且不斷通過碳市場鏈接等合作方式，與具有共同利益的國家形成“碳聯盟”，導致了國際碳交易合作的“碎片化”。無疑更加劇了《巴黎協定》下碳交易國際協調的困難。在這種背景之下，對我國的碳交易制度建設和域外合作也形成了極大的挑戰，不利於我國順利實現“雙碳目標”。所以，面對《巴黎協定》的談判困境，我國應當認真探究其背後的真實原因、分析各爭議焦點，及其對我國帶來的挑戰，探索因應之道。因此，本文基於“理論闡釋——制度解析——實踐分析——發現問題——解決問題”的邏輯主線，對碳交易制度國際協調的法律問題展開研究。除引言和結論部分外，正文部分共五章，具體內容如下：第一章，“碳交易國際協調相關要素闡釋”。第二章，“碳交易市場國際協調的發展與規則嬗變”。第三章，“國際主要的碳交易市場與區域協調實踐”。第四章，“《巴黎協定》下碳交易國際協調合作的挑戰與原因探究”。第五章，“碳交易全球協調下中國有效參與的困境及紓困路徑”。
