出版日:2025/09/27 作者:Christopher Heath Wellman  出版社:Oxford Univ Pr  裝訂:精裝
Rights and Resistance features ten essays by Christopher Heath Wellman on our moral rights, and the measures we may take to protect them. In addition to offering original accounts of various rights, in these essays Wellman considers how we may permissibly enforce our moral claims against others on both the individual and political levels. Virtually everyone agrees that we may defend our rights with only necessary and proportionate force, but should we accept these restrictions even when our resistance would be unnecessary or disproportionate only because a wrongdoer is employing overpowering force? What about citizens who endure political injustice? Although it is no longer fashionable to insist that we must obey the laws of an illegitimate regime, most theorists remain reluctant to condone forcible resistance against a legitimate government. Given that states can be fully legitimate without being perfectly just, prohibiting resistance against legitimate regimes requires oppressed citi

Does the Hebrew Bible ascribe an implicit form of legal personhood or legal rights to animals? If so, which animals--domesticated or wild, or both--receive which rights, and for what purpose? Scholars have been slow to consider these questions, and animal-oriented research as a whole, in the field of biblical studies. For the first time, author Saul M. Olyan addresses these questions in detail and explores how the evidence of the Hebrew Bible might contribute to contemporary debates about animal rights in the academy, in the courts, in the public square, and in religious communities. In this book, Olyan demonstrates that seven different biblical texts extend both legal personhood and rights to animals. The rights conferred upon them are mainly specific and situational, and the legal personhood associated them is in most cases best characterized as limited. Nonetheless, he argues that the animal rights described by these texts are genuine because they are not contingent on the needs or

Human Rights After Deleuze
滿額折
出版日:2022/11/03 作者:Christos Marneros  出版社:Hart Publishing UK  裝訂:精裝
This book examines the possibility of creating new ways of existing beyond human rights. Multiple socio-political crises and the dominance of neoliberal and capitalist policies have led legal and political theorists to question the emancipatory promise of human rights and to reconceptualise human rights in theory and practice. The possibility of creating new ways of existing beyond human rights has been left significantly under examined, until now. Having as its starting point the ferocious, yet brief, critique on human rights of one of the most prominent French philosophers of the 20th century, Gilles Deleuze, the book argues that Deleuze’s critique is not only compatible with his broader thought but that it has the potential to give a new impetus to the current critiques of human rights, within the ‘disciplinary borders’ of legal and political theory. The book draws upon Deleuze’s broader thought, but also radical legal and political theory and continental philosophy. In particular

Although the evolution of human rights diplomacy during the second half of the 20th century has been the subject of a wealth of scholarship in recent years, British foreign policy perspectives remain largely underappreciated. Focusing on former Foreign Secretary David Owen’s sustained engagement with the related concepts of human rights and humanitarianism, David Owen, Human Rights and the Remaking of British Foreign Policy addresses this striking omission by exploring the relationship between international human rights promotion and British foreign policy between c.1956-1997. In doing so, this book uncovers how human rights concerns have shaped national responses to foreign policy dilemmas at the intersections of civil society, media, and policymaking; how economic and geopolitical interests have defined the parameters within which human rights concerns influence policy; how human rights considerations have influenced British interventions in overseas conflicts; and how activism

Catholic Cosmopolitanism and Human Rights
90 折
出版日:2022/08/11 作者:Leonard Francis Taylor  出版社:Cambridge Univ Pr  裝訂:平裝
It is because Catholicism played such a formative role in the construction of Western legal culture that it is the focal point of this enquiry. The account of international law from its origin in the treaties of Westphalia, and located in the writing of the Grotian tradition, had lost contact with another cosmopolitan history of international law that reappeared with the growth of the early twentieth century human rights movement. The beginnings of the human rights movement, grounded in democratic sovereign power, returned to that moral vocabulary to promote the further growth of international order in the twentieth century. In recognising this technique of periodically returning to Western cosmopolitan legal culture, this book endeavours to provide a more complete account of the human rights project that factors in the contribution that cosmopolitan Catholicism made to a general theory of sovereignty, international law and human rights.

Regional Courts, Domestic Politics, and the Struggle for Human Rights

出版日:2022/07/07 作者:Jillienne Haglund  出版社:Cambridge Univ Pr  裝訂:平裝
Despite substantial growth in past decades, international human rights law faces significant enforcement challenges and threats to legitimacy in many parts of the world. Regional human rights courts, like the European and Inter-American Courts of Human Rights, represent unique institutions that allow individuals to file formal complaints with an international legal body and render judgments against states. In this book, Jillienne Haglund focuses on regional human rights court deterrence, or the extent to which adverse judgments discourage the commission of future human rights abuses. She argues that regional court deterrence is more likely when the chief executive has the capacity and willingness to respond to adverse regional court judgments. Drawing comparisons across Europe and the Americas, this book uses quantitative data analyses, supplemented with qualitative evidence from many adverse judgments, to explain the conditions under which regional courts deter future rights abuses.

出版日:2022/07/07 作者:Gerald L. Neuman  出版社:Cambridge Univ Pr  裝訂:平裝
The electoral successes of right-wing populists since 2016 have unsettled world politics. The spread of populism poses dangers for human rights within each country, and also threatens the international system for protecting human rights. Human Rights in a Time of Populism examines causes, consequences, and responses to populism in a global context from a human rights perspective. It combines legal analysis with insights from political science, international relations, and political philosophy. Authors make practical recommendations on how the human rights challenges caused by populism should be confronted. This book, with its global scope, international human rights framing, and inclusion of leading experts, will be of great interest to human rights lawyers, political scientists, international relations scholars, actors in the human rights system, and general readers concerned by recent developments.

The Politics of Rights and Southeast Asia

出版日:2022/05/31 作者:Lynette J. Chua  出版社:Cambridge Univ Pr  裝訂:平裝
What do rights mean in Southeast Asia? How do differently situated individuals, social groups, and institutions, make sense of and deploy concepts of rights? How do their concepts relate to religious beliefs, norms, and practices that underpin social hierarchy and relations, as well as experiences with and memories of political conflict and post-colonial developments? What are the consequences of asserting rights? This Element takes a 'politics of rights' approach. The approach treats rights not merely as substantive or normative meanings found in international law, regional instruments and domestic constitutional documents, but as political processes: Rights come to life through ongoing series of social interactions. The approach in this Element helps readers understand the often contradictory findings about rights in a manner sensible to political subjectivities and helps readers make sense of why rights are sometimes helpful to Southeast Asians who appeal to them, sometimes disappoi

The Transforming Power of Cultural Rights: A Promising Law and Humanities Approach

出版日:2022/05/26 作者:Helle Porsdam  出版社:Cambridge Univ Pr  裝訂:平裝
Cultural rights promote cultural and scientific creativity. Transformative and empowering, they also enable the pursuit of knowledge and understanding, thereby working as atrocity prevention tools. The Transforming Power of Cultural Rights argues that this gives these rights a central role to play in promoting the full human personality and in realizing all other human rights. Looking at the work of the UN Special Rapporteurs in the field of cultural rights as well as UNESCO's efforts, Helle Porsdam addresses the question of how a universal human rights agenda can include a dialogue that recognizes the importance of cultural diversity without sliding into cultural relativism. She argues that cultural rights offer a useful international arena and discourse in which to explain and negotiate cultural meanings when controversies arise. This places them at the center of human rights - and at the center of law and humanities.

A short book about the challenges to liberalism from the right and the left by the New York Times bestselling author of Identity: The Demand for Dignity and the Politics of Resentment. Classical liberalism is in a state of crisis. Developed in the wake of Europe's wars over religion and nationalism, liberalism is a system for governing diverse societies, grounded in fundamental principles of equality and the rule of law. It emphasizes the rights of individuals to pursue their own forms of happiness free from encroachment by government. It's no secret that liberalism didn't always live up to its own ideals. In America, many people were denied equality before the law. Who counted as full human beings worthy of universal rights was contested for centuries, and only recently has this circle expanded to include women, African-Americans, LGBTQ people, and others. Conservatives complain that liberalism empties the common life of meaning. As the renowned political philosopher Francis Fukuyama

Patent rights on pharmaceutical products are one of the factors responsible for the lack of access to affordable medicines in developing countries. In this work, Emmanuel Kolawole Oke provides a systematic analysis of the tension between patent rights and human rights law, contending that, in order to preserve their patent policy space and secure access to affordable medicines for their citizens, developing countries should incorporate a model of human rights into the design, implementation, interpretation, and enforcement of their national patent laws. Through a comprehensive analysis of court decisions from three key developing countries (India, Kenya, and South Africa), Oke assesses the effectiveness of national courts in resolving conflicts between patent rights and the right to health, and demonstrates how a model of human rights can be incorporated into the adjudication of patent rights.

Social Rights and the Politics of Obligation in History

出版日:2022/01/06 作者:Steven L. B. Jensen  出版社:Cambridge Univ Pr  裝訂:精裝
This pioneering volume explores the long-neglected history of social rights, from the Middle Ages to the present. It debunks the myth that social rights are 'second-generation rights' – rights that appeared after World War II as additions to a rights corpus stretching back to the Enlightenment. Not only do social rights stretch back that far; they arguably pre-date the Enlightenment. In tracing their long history across various global contexts, this volume reveals how debates over social rights have often turned on deeper struggles over social obligation – over determining who owes what to whom, morally and legally. In the modern period, these struggles have been intertwined with questions of freedom, democracy, equality and dignity. Many factors have shaped the history of social rights, from class, gender and race to religion, empire and capitalism. With incomparable chronological depth, geographical breadth and conceptual nuance, Social Rights and the Politics of Obligation in Histor

Human Rights and Economic Inequalities

出版日:2021/09/30 作者:Gillian MacNaughton  出版社:Cambridge Univ Pr  裝訂:精裝
Economic inequalities are among the greatest human rights challenges the world faces today due to the past four decades of neoliberal policy dominance. Globally, there are now over 2,000 billionaires, while 3.4 billion people live below the poverty line of US $5.50 per day. Many human rights scholars and practitioners read these statistics with alarm, asking what impact such extreme inequalities have on realizing human rights and what role, if any, should human rights have in challenging them? This edited volume examines these questions from multiple disciplinary perspectives, seeking to uncover the relationships between human rights and economic inequalities, and the barriers and pathways to greater economic equality and full enjoyment of human rights for all. The volume is a unique contribution to the emerging literature on human rights and economic inequality, as it is interdisciplinary, global in reach and extends to several under-researched areas in the field.

This groundbreaking study understands the 'long history' of human rights in Australia from the moment of their supposed invention in the 1940s to official incorporation into the Australian government bureaucracy in the 1980s. To do so, a wide cast of individuals, institutions and publics from across the political spectrum are surveyed, who translated global ideas into local settings and made meaning of a foreign discourse to suit local concerns and predilections. These individuals created new organisations to spread the message of human rights or found older institutions amenable to their newfound concerns, adopting rights language with a mixture of enthusiasm and opportunism. Governments, on the other hand, engaged with or ignored human rights as its shifting meanings, international currency and domestic reception ebbed and flowed. Finally, individuals understood and (re)translated human rights ideas throughout this period: writing letters, books or poems and sympathising in new, glob

In this book, Hedi Viterbo radically challenges our picture of law, human rights, and childhood, both in and beyond the Israel/Palestine context. He reveals how Israel, rather than disregarding international law and children's rights, has used them to hone and legitimize its violence against Palestinians. He exposes the human rights community's complicity in this situation, due to its problematic assumptions about childhood, its uncritical embrace of international law, and its recurring emulation of Israel's security discourse. He examines how, and to what effect, both the state and its critics manufacture, shape, and weaponize the categories 'child' and 'adult.' Bridging disciplinary divides, Viterbo analyzes hundreds of previously unexamined sources, many of which are not publicly available. Bold, sophisticated, and informative, Problematizing Law, Rights, and Childhood in Israel/Palestine provides unique insights into the ever-tightening relationship between law, children's rights,

To advance the rationale of scholarship for social change, An-Naim proposes advancing the universality of human rights through internal discourse within Islamic and African societies and cross-cultural dialogue among human cultures. This book proposes a transformation from human rights organized around a state determined practice to one that is focused on a people-centric approach that empowers individuals to decide how human rights will be understood and integrated into their communities. Decolonizing Human Rights aims to illustrate the decisive role of human agency on the subject of change, without implying that Islamic or any other society are exceptionally disposed to politically motivated violence and consequent profound political instability.

Property Rights and Social Justice analyses 'progressive property' in action by examining the role of constitutional property rights guarantees in mediating private ownership and social justice. It combines insights from property theory with enlightening doctrinal analysis of the interaction between property rights and social justice in the constitutional and broader legal context. It does so through the prism of the Irish Constitution's property guarantees, which uniquely in the English-speaking, common law world both protect property rights and requires their regulation by the State to secure social justice. Through this analysis, the book grounds key debates in contemporary property theory in fresh, illuminating doctrinal examples, and enhances global debates about the constitutional protection of property rights. It argues that primacy is perhaps inevitably afforded to political determinations about the appropriate mediation of property rights and social justice, meaning that the p

It explores developments in the institutional contexts within which rights claiming occurs and in the sources of support available for utilizing different claims-making channels. Drawing on scores of original interviews, readings of court rulings and statutes, primary archival and digital sources, and interpretive analysis of news media coverage in Korean, this volume illuminates rights in action. International treaties are the primary means for codifying global human rights standards. However, nation-states are able to make their own choices in how to legally commit to human rights treaties. A state commits to a treaty through four commitment acts: signature, ratification, accession, and succession. These acts signify diverging legal paths with distinct contexts and mechanisms for rights change reflecting legalization, negotiation, sovereignty, and domestic constraints. How a state moves through these actions determines how, when, and to what extent it will comply with the human rights treaties it commits to. Using legal, archival, and quantitative analysis this important book shows that disentangling legal paths to commitment reveals distinct and significant compliance outcomes. Legal context matters for human rights and has important implications for the conceptualization of treaty commitment, the consideration of non-binding commitment, and an optimistic outlook for the impa

Vernacular Rights Cultures offers a bold challenge to the dominant epistemologies and political practices of global human rights. It argues that decolonising global human rights calls for a serious epistemic accounting of the historically and politically specific encounters with human rights, and of the forms of world-making that underpin the stakes and struggles for rights and human rights around the globe. Through combining ethnographic investigations with political theory and philosophy, it goes beyond critiquing the Eurocentrism of global human rights, in order to document and examine the different political imaginaries, critical conceptual vocabularies, and gendered political struggles for rights and justice that animate subaltern mobilisations in 'most of the world'. Vernacular Rights Cultures demonstrates that these subaltern struggles call into being different and radical ideas of justice, politics and citizenship, and open up different possibilities and futures for human right

Law, Democracy and the European Court of Human Rights examines the political rights jurisprudence of the European Court of Human Rights. It discusses how the Court supports a liberal representative and substantive model of democracy, and outlines the potential for the Court to interpret the Convention so as to support more deliberative, participatory and inclusive democratic practices. The book commences with an overview of different theories of democracy and then discusses the origins of the Council of Europe and the Convention and presents the basic principles on the interpretation and application of the Convention. Subsequent chapters explore issues around free expression, free assembly and association, the scope of the electoral rights, the right to vote, the right to run for election and issues about electoral systems. Issues discussed include rights relating to referendums, voting rights for prisoners and non-nationals, trade union rights and freedom of information.

Leading historians, anthropologists, political theorists, legal scholars, and scholars of religion develop fresh approaches to issues such as human dignity, personalism, religious freedom, the role of ecumenical and transatlantic networks, and the relationship between Christian and liberal rights theories. In doing so they move well beyond the temporal and geographical limits of the existing scholarship, exploring the connection between Christianity and human rights, not only in Europe and the United States, but also in Africa, Latin America, and China. They offer alternative chronologies and bring to light overlooked aspects of this history, including the role of race, gender, decolonization, and interreligious dialogue. 出版日:2020/08/31 作者:Lea David  出版社:Cambridge Univ Pr  裝訂:精裝
In this innovative study, Lea David critically investigates the relationship between human rights and memory, suggesting that, instead of understanding human rights in a normative fashion, human rights should be treated as an ideology.
