Arguing that many economic rights granted by the modern regulatory state--e.g., the awarding of government contracts, occupational licenses and franchises, the use of publicly-owned resources--constitute a new form of property rights and thus a new system of law (regulatory property) this study investigates whether these state-created entitlements can be handled like other goods in a market framework through secondary trading. Focusing on a European context, the study looks at airport slots, broadcast spectrum rights, milk quotas, and carbon emission allowances and explores legislation and issues of allocation and management of these entitlements through a comparative methodological lens that incorporates private law, public law, and law and economics approaches.
