本書基於比較法觀點，就美國、歐盟、日本、加拿大、香港、新加坡及越南等國家（或地區），向WTO所提報「貿易政策報告」（Trade Policy Report）及美中二大經濟體為WTO會員國關切議題作探討。美國加州大學史坦伯利教授指出，「創意」為國際貿易之主戰場，且人類未來將從事「創意貿易」，任何一個進步及文明國家均應尊重知慧財；另歐洲國際經濟法學者伯莫斯特（Edwin Vermulst）嘗謂，國際貿易談判是一場永不休止之過程（never-ending process），永遠需要面對未來之挑戰（there is always a challenge ahead）。二氏之言，均可謂深切著明，信而有徵。本書作者為立法院於1996年委由中央研究院比照甲考（現稱高考一級）模式舉辦甄試，分門別類，以國際貿易政策類科第一名錄取，進入立法院立法諮詢中心（立法院法制局前身）擔任研究工作。在此之前，於經濟部國際貿易局（署）任職期間曾先後奉派赴美、歐、日、韓及WTO總部考察。
